Misleading Obamacare News Reports That Could Cost You

Obamacare. There are news reports going around leading people to believe that there will be no retribution from the IRS if you do not buy into the Affordable Care Act (ACA) more commonly known as Obamacare. Reports from newscasters like MSNBC’s host Lawrence O’Donnell claim that there will be no criminal charges levied against anyone who doesn’t pay the first year fine of $95 for not having health insurance. The impression being given is that if you do not pay the IRS fine then there is nothing the government can do to you.

What is being used to support this claim comes from page 131 of the ACA. It is posted below verbatim. But as we find out what is being purported by the news and what is actually written into law are two separate things.

But as Christians, are we to automatically, “Render therefore unto Caesar the things which are Caesar’s”? Following the facts about the Obamacare fee is a discussion about what is and what is not “Ceasar’s”

obamacare penalty‘‘(g) ADMINISTRATION AND PROCEDURE.—

‘‘(1) IN GENERAL.—The penalty provided by this section shall be paid upon notice and demand by the Secretary, and except as provided in paragraph (2), shall be assessed and collected in the same manner as an assessable penalty under subchapter B of chapter 68.

‘‘(2) SPECIAL RULES.—Notwithstanding any other provision of law—

‘‘(A) WAIVER OF CRIMINAL PENALTIES.—In the case of any failure by a taxpayer to timely pay any penalty imposed by this section, such taxpayer shall not be subject to any criminal prosecution or penalty with respect to such failure.

‘‘(B) LIMITATIONS ON LIENS AND LEVIES.—The Secretary shall not—

‘‘(i) file notice of lien with respect to any property of a taxpayer by reason of any failure to pay the

penalty imposed by this section, or ‘‘(ii) levy on any such property with respect to such failure.’’.

In short what the bill says that if someone does not have health insurance and does not pay the $95 per person fine (That’s the first years fine. It goes up during subsequent years) then there will be no “criminal prosecution” or lien on your personal property.

It does NOT say the IRS will leave you alone!

“If an individual does not carry insurance coverage and does not have exemptions, that’s where a tax penalty (from the IRS) could come into play. In 2014, the health law includes a $95 penalty for not carrying health insurance. This penalty is administered by the Internal Revenue Service (IRS) through the tax return system. In order to collect, the IRS will typically dock that amount from an individual’s tax return.” Washington Post.

OK, so what happens if you don’t get the insurance, won’t pay the fine and don’t get a tax refund?

“If you don’t get a refund or the penalty is greater than your refund, the agency will want you to mail a check to them or send funds electronically,” reports the Daily Finance.

How about if someone takes a stand and refuses to send the fee/charge into the IRS?

“The IRS could take it out of any future tax refunds. If your taxes are withheld through your employer, the agency could also get the money through that route,” the Daily Finance adds.

It is true that criminal charges and liens on personal property will not be levied against you if you do not pay the IRS for Obamacare. But that doesn’t mean the IRS will not pursue after the monies you owe now and on into the future. Again, the first year fine is $95 per person and will increase in following years. The IRS fine for not having Obamacare or health insurance will go up each year after that. Refusal to pay the IRS fine could aggregate to a rather hefty sum over the years.

Render Unto Caesar

Matthew 22:15-22

If Caesar should intrude into the things of God

“But remember, if Caesar should intrude into the things of God, coin a new creed, or broach a new Gospel, and affect to rule the conscience, while he rules the state, in these things Caesar is not to be obeyed; he is taking the things of God, and he must not get them. Give not therefore God‘s things to Caesar, and give not Caesar‘s things to God. That which belongs to
the commonwealth should, on no account whatever, be devoted to religious uses; and let no man think he has pleased God, by giving that to charitable or sacred uses which he has purloined from the state.” Adam Clarke

IRS and Obamacare

The Affordable Care Act (Obamacare) is one of the most substantial pieces of legislation ever passed in the United States. Implications and mandates affect everyone. It is not the job of Refining Truth to tell you what to think or do in regards to Obamacare or the IRS. But accurate information about any decision is mandatory.
